The Constitution is the Australian Federation’s overarching legal document and it’s written in plain English so ordinary people can understand it.
Its opening paragraph is the contract between we the people and those who would govern us.
“WHEREAS the people of New South Wales, Victoria, South Australia, Queensland, and Tasmania, humbly relying on the blessing of Almighty God, have agreed to unite in one indissoluble Federal Commonwealth under the Crown of the United Kingdom of Great Britain and Ireland, and under the Constitution hereby established:”
Our Constitution can only be changed via referendum and it cannot be set aside for any reason.
Our state Premiers’ COVID-19 border closures breached our Constitution.
Section 117 reads; “A subject of the Queen, resident in any State, shall not be subject in any other State to any disability or discrimination which would not be equally applicable to him if he were a subject of the Queen resident in such other State.”
The Premiers have unlawfully destroyed our domestic tourism industries and have escaped sanction or correction.
So, whose job is it to correct the Premiers? That’d be the Queen’s, via our Governor-General.
Section 61: “The executive power of the Commonwealth is vested in the Queen and is exercisable by the Governor-General as the Queen’s representative, and extends to the execution and maintenance of this Constitution, and of the laws of the Commonwealth.”
What exactly is David Hurley doing for his $495,000 pa if he’s not “maintaining the Constitution”?
Inquiring minds would like to know.
